So it’s really going to depend on the circumstance for which the legality of the blade is in question. If they want to nab you they’re going to nab you and even if it if you get the case dismissed, that’s going to cost more than the value of the knife. Don’t wear it on your pocket with the clip out or exposed, especially when riding the train. End of the day it’s New York so it’s really up to the cop that’s questioning you at the end of the day. There’s been situations where they simply confiscate it and others where they’ll book you and the charges are dropped. These days the city cops have been saying folding knives are illegal while fixed blades are legal. The ambiguity of the legality leaves a lot to question.
